1. Subject
These general terms and conditions define the rights and obligations of the parties in the context of the remote booking of services offered by Hôtel le Sénat on its Website and mobile Services.
They govern all stages necessary for the reservation and follow-up of the reservation between the contracting parties.
Any reservation therefore implies the customer's full and unreserved acceptance of these conditions.
All customers acknowledge that they have the capacity to contract, i.e. that they are of legal age and not under guardianship.
Throughout this text, the names "Hotel" and "site" refer to the site named Hôtel Sénat and corresponding to the domain name that can be consulted atwww.hotelsenat.com.
2. Scope of application
These general terms and conditions of sale apply to all reservations made over the Internet, via the Website or Mobile Services and its partners.
3. Opposability of general conditions
In any event, the version of the general terms and conditions of sale enforceable against the customer is that in force at the time of his reservation on the Website or Mobile Services or with its partners.
4. Booking
Reservations can be made via the website, by telephone, by e-mail or by post.
Reservations will only be effective if guaranteed by the customer, either by providing a valid credit card number or by paying a deposit, and after receipt of a detailed reservation confirmation.
Payment for all services must be made directly to the hotel at the checkin (except for reservations prepaid at the time of booking).
The hotel reserves the right to refuse any reservation if the credit card number is incorrect or the reservation incomplete.
Reservations from all sources are payable in euros only.
The hotel accepts the following credit cards: Visa, Mastercard and American Express, and has a secure reservation system (SSL) that protects and encrypts all sensitive data transmitted to the reservation to prevent any disclosure to a third party.
At the time of booking, a credit card debit authorization will be issued. This will be done for information purposes, and will in no case be a debit to the account except in the following cases: No shows
Booking via intermediaries
- Reservations made by the customer via partner services are made via the dematerialized reservation form accessible online on the website and mobile services of each partner.
- The reservation is deemed to have been made upon receipt of the reservation form or reservation request by the hotel, or upon online prepayment by credit card.
- Prior to any reservation, the customer undertakes to complete the information requested on the reservation form or request.
- The customer attests to the truthfulness and accuracy of the information provided.
- The booking procedure includes the following stages:
Stage 1: choice of hotel, room and rate;
Step 2: selection of one or more additional services (valid only on the Site);
Step 3: verification of booking details, total price, applicable sales conditions and possible adjustment of choice (room, rate, additional service), in the case of online booking only;
Step 4: Enter customer details;
Step 5: credit card entry in the case of guarantee or prepayment requests.
Step 6: consultation and acceptance of the general terms and conditions of sale and the terms and conditions of sale for the fare booked, before confirming the booking;
Step 7: validation of the booking by the customer.
5. Payment
The customer must present the credit card used to guarantee the reservation or make the prepayment at the hotel.
The hotel may also ask for proof of identity to prevent credit card fraud.
Payment is debited at the hotel during the stay, except in the case of special conditions or rates where payment is debited at the time of booking (online prepayment for certain rates). This prepayment is referred to as a deposit.
In the case of rates that are not prepaid online, the hotel may ask the customer to pay the entire stay and a security deposit or authorize a credit card charge on arrival, in order to guarantee payment of the sums corresponding to the services consumed on site.
Deposits can be paid in two ways:
- by cheque made payable to the hotel and sent directly to the hotel, or
- or by credit card.
In the latter case, the reservation becomes firm and definitive only on receipt of the deposit by the hotel within the specified time.
The balance of the stay must be paid on site to the hotelier.
6. Right of withdrawal
In accordance with article L. 121-21-8 12° of the French Consumer Code, customers are reminded that they do not have the right of withdrawal provided for in article L. 121-21 of the French Consumer Code.
The Conditions of Sale for the fare booked specify the terms and conditions for cancelling and/or modifying the booking.
7. Change of stay
Any change to a reservation must be requested by e-mail from the hotel or by telephone on +33 (0)1 43 54 54 54 or reservations@hotelsenat.com.
The request will only become effective once the hotel has confirmed its acceptance in writing.
In the event of a change to the stay, the following conditions apply (except in cases of force majeure):
- In the event of a no-show on the scheduled arrival date, your credit card will be charged for the first night's stay.
- Any stay commenced is payable in full.
8. Cancellation of stay
All cancellations must be notified to the hotel by e-mail or telephone at least 48 hours in advance.
The request will only become effective once the hotel has confirmed its acceptance in writing or orally.
In the event of cancellation of a stay, the following conditions apply (except in cases of force majeure):
- For any request made less than 48 hours before the scheduled arrival date, the amount of the first night will be charged.
- In the event of a no-show on the scheduled arrival date, your credit card will be charged for the first night's stay.
- Any stay commenced is payable in full.
9. Force majeure
Force majeure is defined as any unforeseeable, insurmountable event external to the parties which prevents either the customer or the hotelier from fulfilling all or part of their obligations under the contract.
Cases of force majeure or fortuitous events are those usually recognized by the jurisprudence of French courts.
Each party may not be held liable to the other party in the event of non-performance of its obligations resulting from an event of force majeure.
It is expressly agreed that force majeure suspends, for the parties, the performance of their mutual obligations and that each party shall bear the costs arising therefrom.
10. Prices
Prices are quoted in Euros.
VAT is always included.
The prices indicated include only the services strictly mentioned in the reservation.
Any additional services provided by the hotelier during the stay and, where applicable, tourist tax, will be added to the price mentioned in the reservation at the time of invoicing.
The applicable prices are those in force on the day of booking. As independent professionals, hoteliers are free to change their prices at any time. Only the price indicated on the booking confirmation is binding.
11. Complaints, disputes
All complaints must be made to the hotelier within 30 days of the date of stay.
Failing recourse to the conventional mediation procedure or any alternative dispute resolution method within 30 days, either party may bring the matter before the competent court.
In accordance with the Decree of October 30, 2015 relating to the mediation of consumer disputes, the contact details of the mediator can be consulted in article 14 below.
12. Responsibilities
It is the Hotel Owner's responsibility to take out all guarantees and insurance necessary for the reception of the public in his Establishment and for the exercise of his activity.
The Hotel's liability is limited in the event of theft of goods or objects when they have been entrusted to its care only.
The customer is responsible for the safekeeping of his or her property and equipment. Customers must inform the hotel of any damage caused by them. He/she is responsible for all damage caused by his/her intermediary and undertakes, in the event of damage to the premises made available (room, common areas such as swimming pool, jacuzzi, garden, lounge, sanitary facilities) to bear the cost of repair.
Any behavior contrary to public morality and order will lead the hotelier to ask the customer to leave the establishment without any compensation or refund if payment has already been made. If no payment has yet been made, the customer must pay the price of the nights consumed before leaving the establishment.
The customer undertakes not to invite any person whose behavior is likely to be prejudicial to the establishment, which reserves the right to intervene if necessary. Customers may not bring in any outside drinks or foodstuffs without prior authorization from the management. The customer undertakes to ensure that participants and their guests comply with all the rules and regulations of the establishment (in particular the smoking ban). The customer shall ensure that participants do not disrupt the operation of the establishment or endanger the safety of the establishment or persons in it.
Unless otherwise expressly agreed, the customer must leave the room before noon on the day the reservation ends. Failure to do so will result in an additional night's charge.
Pets are accepted at the discretion of the hotel management. Pet owners are fully responsible for their pets' behaviour.
The hotel offers free WIFI access enabling guests to connect to the Internet. The customer undertakes to ensure that the computer resources made available by the hotel will not be used in any way for the purpose of reproducing, representing, making available or communicating to the public works or objects protected by copyright or other intellectual property rights.s by copyright or related rights, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Intellectual Property Code, where such authorization is required. The photographs presented on the Site and the hotel's mobile services or those of its partners are for information purposes only. Although every effort is made to ensure that the photographs, graphics and texts reproduced to illustrate the hotels presented give as accurate an idea as possible of the accommodation services offered, variations may occur, notably due to changes in furnishings or possible renovations.
The hotel cannot be held responsible for the non-execution or poor execution of the reservation in the event of force majeure, the unforeseeable and insurmountable act of a third party, the act of the customer, in particular theunavailability of the Internet network, impossibility of access to the website, external intrusion, computer viruses or in the event of unauthorized prepayment by the bearer's bank.
13. Relocation
In the event of an exceptional event or the impossibility of making the reserved room available to the customer, or in the event of force majeure, the chosen hotel reserves the right to to accommodate the customer in whole or in part in a hotel of an equivalent category, for services of the same nature and subject to the customer's prior agreement.
Any additional cost of the room, transport between the two hotels and a telephone call will be borne by the chosen hotel.
14. Mediation
